Programa de Pós-Graduação em Direito ; Esta tese trabalho tem como objeto de análise os desdobramentos da ontologia marxista de Georg Lukács no campo do direito, em especial, dos direitos humanos. O trabalho se explicita como fundamento do desenvolvimento do ser social. A base ontológico-genética do trabalho possibilita o surgimento dos distintos complexos da totalidade social, que se desenvolvem de forma tendencial por meio da contínua expansão das forças produtivas, recuo das barreiras naturais e aumento da sociabilidade do ser social. A estrutura econômica se constitui no momento predominante do desenvolvimento dos demais complexos sociais, sem estabelecer relações hierárquicas. O complexo jurídico como regulação social tem sua gênese nos efeitos do desenvolvimento da base econômica, em especial decorrente da divisão da sociedade em classes antagônicas. A divisão social do trabalho vai possibilitar o surgimento de um grupo especial cujo mandato social é o exercício da jurisdição. O complexo jurídico exerce a função ideológica específica de orientar a práxis dos indivíduos por meio de preceitos abstratos coativamente sancionados pelo Estado. A estrutura jurídica não é indiferente às contradições decorrentes da base econômica. As contradições de classe fundamentam a necessidade da dominação de classe concretizar-se através de diferentes compromissos com as outras classes sociais. O complexo jurídico é capaz de realizar a mediação entre as distintas classes sociais, mantendo velada a dominação de determinada classe específica. Os direitos humanos têm sua gênese histórica articulada com a ascensão da revolução burguesa, que ao mesmo tempo foi expressão do desenvolvimento da generidade humana e contraditoriamente subordina esta generidade à particularidade da ordem burguesa. Para que os direitos humanos venham a corresponder ao desenvolvimento da essência do ser social é necessário superar o ciclo vicioso das particularidades, transformando a estrutura econômica de tal maneira que possibilite a extinção das classes sociais e com elas o fim da pré-história da humanidade. ; This thesis has as object of analysis the unfolding of Georg Lukacs' marxist ontology in the field of law, especially in the human rights. The labour explicit itself as a foundation of social being#s evolution. The ontological-genetic base of labour enables the advent of the distinct complex of social totality, which develops in a tendentiously form by the continuous expansion of productive forces, retraction of the natural barriers and increase of social being#s socialization. The economic structure, constitute itself, in a predominant moment of the development of other complex social, without establishing hierarchical relationships. The legal complex as a social regulation has it genesis in the social effects of the development of economic base, in particular from the division of society into antagonistic classes. The social division of labour has allowed the emergence of a special group whose social mandate is the exercise of jurisdiction. The legal complex acts as specific ideological function to orientate the practice of the individuals through abstract precepts sanctioned by the State with coercion. The legal structure is not indifferent to contradictions arising from the economic base. The class contradictions underlying the necessity of class' domination materialize itself, through various compromises with the other social classes. The legal complex is capable of performing the mediation between different social classes, maintaining veiled the domination of certain specific class. The human rights have their historical genesis combined with the rise of the bourgeois revolution that was, at the same time, expression of the evolution of human generality and, paradoxically, subordinate this generality to a particularity of the bourgeois order. For the human rights will correspond to the evolution of the essence of social being is necessary to overcome the vicious cycle of particularities, transforming the economic structure in such a way that allow the extinction of social classes and with them, the end of the prehistory of humanity.
