Fundamental Social Right to Housing: on the effectiveness of this right and its autonomy with respect the right to property. (English)

This paper aims to discuss on forms that permit to understand Right to Housing as a fundamental social right, advocating for the necessity that in the general theory of law, apart it from the right to property in order to, in adequacy to the content of the international treatises and the Brazilian Constitution, finally declare its autonomy. To the accomplishment of this research we used the hypothetic-deductive method, intending to confirm the hypothesis by which Right to Housing is an autonomous fundamental right, independent from the right to property. Neste trabalho são discutidas formas que possibilitem compreender o Direito à Moradia como um direito social fundamental, pugnando pela necessidade de, no âmbito da teoria geral do direito, desvinculá-lo do direito de propriedade para, em adequação ao conteúdo dos tratados internacionais e da própria Constituição Federal, ser finalmente declarada sua autonomia. Para a realização desta pesquisa foi utilizado o método hipotético-dedutivo, visando à comprovação da hipótese segundo a qual o direito à moradia é direito fundamental autônomo, independente do direito de propriedade. O trabalho foi baseado em revisão bibliográfica nacional, bem como na revisão de documentos oficiais (em especial jurisprudência e textos normativos vigentes). [ABSTRACT FROM AUTHOR]
