      Determination of damages still poses a serious problem when it comes to the legal aproach of wrongful birth actions. However, the number of decisions issued by the Spanish Supreme Court provides enough background to conduct an analysis of predominant legal tendencies concerning this subject. In this regard, the aim of this paper is to perform more than a mere analysis of the different decisions; in fact, the aim it is to determine whether it exits or not an actual case law apropos the determination of damage in wrongful birth actions exist or not.       La determinación del daño sigue suponiendo un gran problema en el tratamiento de las acciones de wrongful birth. Sin embargo, el volumen de sentencias emitidas por el Tribunal Supremo permite discernir una serie de tendencias mayoritarias. Analizando estas últimas, este trabajo no se limita, como es común, a exponer las sentencias existentes sobre la materia, sino que trasciende de la exposición y tiene como objetivo comprobar si existe una verdadera jurisprudencia en relación a la identificación del daño, como elemento clave de las acciones de wrongful birth.
