The non-violent occupation of property: the summary offence of usurpation (art. 245.2 CP).

This paper, after an approach to the social drama and legal problem of the occupation of empty houses in Spain, addresses the dogmatic analysis the crime of peaceful occupation of real estate of article 245.2 CP, paying special attention to the most controversial questions of the type, to respond, thus, to some of the interpretative and applicational problems this outlines. Finally, it studies the legal and criminal treatment given to organized groups that mediate in occupations for profit, and the possible viability of a precautionary system of eviction prior to the conviction for the summary offence of usurpation. El presente trabajo, tras una aproximación al drama social y problema legal de la ocupación de viviendas vacías en España, aborda el análisis dogmático el delito de ocupación pacífica de inmuebles del artículo 245.2 CP, prestando especial atención a las cuestiones más controvertidas del tipo, para dar respuesta, así, a algunos de los problemas interpretativos y aplicativos que éste plantea. Se estudia, por último, el tratamiento jurídico-penal que se dispensa a los grupos organizados que intermedian en las ocupaciones con finalidad lucrativa; y la posible viabilidad de un sistema cautelar de desalojo con carácter previo a la sentencia condenatoria por delito leve de usurpación.
