Specific and local jurisdiction in family cases according to the latest legal and judicial. (English)
    • Abstract:
The family is one of the oldest human organizations that has gone through stages of development over time, and this development also had an impact on the level of legal and judicial organization. The latter passed through fundamental changes in the field of the family, beginning with the stage of applying the provisions of Islamic law to family disputes, especially the Maliki school of thought before colonialism. After the French colonial takeover and the imposition of the "protection" system in 1912, a specialized judicial system was established to consider family disputes, called the Sharia Courts, in accordance with the Royal Decree of July 7, 1914, in contrast to the Hebrew courts, which to this day still specialize in family disputes for Moroccan Jews. After the new legal amendments, especially at the level of the new judicial organization, 38.15 witnessed modernization, especially at the level of specific jurisdiction in family cases. Local jurisdiction in family cases also maintained the same specificity over the rules of local jurisdiction in civil matters. [ABSTRACT FROM AUTHOR]
