يهدف هذا البحث إلى تحليل معايير الخطاب في ألفاظ الطلاق وتأثيرها على الأحكام القضائية، ويركز على أهمية فهم القاضي لآليات اللغة وتأثيراتها على الأحكام الشرعية، خاصة في قضايا الطلاق التي تتطلب دقة عالية في تحليل الألفاظ والمعاني تكمن أهمية الدراسة في أنها تسهم في توحيد المعايير المستخدمة في تحليل ألفاظ الطلاق، وتعزز فهم القضاة والمحامين لكيفية تحليل هذه الألفاظ بطرق علمية مدروسة. وتتمثل الإشكالية البحثية في كيفية تأثير معايير تحليل الخطاب على فهم ألفاظ الطلاق وتفسيرها في الأحكام القضائية اعتمدت الدراسة على المنهج التحليلي، وقسمت إلى مقدمة وتمهيد ومبحثين وخاتمة. وقد أظهرت النتائج أن معايير تحليل الخطاب تؤثر بشكل كبير على فهم ألفاظ الطلاق وتفسيرها ، ويوضح البحث أهمية السياق اللغوي والسياقات الأخرى المصاحبة في تحديد معنى اللفظ، وأن القاضي يحتاج إلى مجموعة من المعايير لتحليل خطاب المتكلم بلفظ من ألفاظ الطلاق، وأن هذه المعايير تختلف باختلاف السياق والظروف. وأوصت الدراسة بضرورة البحث في معايير تحليل الخطاب في أبواب فقهية أخرى. This research aims to analyze the standards of discourse in divorce terminology and its impact on judicial provisions. It emphasizes the importance of the judge's understanding of linguistic mechanisms and their effects on Sharia-based provisions, especially in divorce cases that require precise analysis of words and meanings. The significance of the research lies in its contribution to unifying the standards used in analyzing divorce terminology, thereby enhancing the understanding of judges and lawyers on how to scientifically and methodically analyze such terms. The research problem focuses on how discourse analysis standards influence the understanding and interpretation of divorce terms in judicial rulings. The research adopted an analytical methodology and is divided into an introduction, a preface, two main sections, and a conclusion. The findings indicate that discourse analysis standards significantly affect the understanding and interpretation of divorce terms. The research highpoints the importance of linguistic and contextual factors in determining the meaning of such terms, asserting that judges require a set of standards to analyze the speaker's discourse when divorce terms are used. These standards vary depending on the context and circumstances. The research recommends further research into discourse analysis standards in other areas of Islamic jurisprudence.
