- Abstract:
Spanish criminal law safeguards the inviolability of the home against unlawful occupation by criminalizing various forms of conduct and imposing penalties on those deemed most serious from a criminal policy standpoint. However, in practice, lawful property owners may find themselves deprived of their rights without immediate legal recourse, prompting some to resort to extralegal measures that may themselves constitute criminal offenses, such as coercion, taking the law into one's own hands, unlawful occupation, or trespassing.This article examines these criminal offenses and the legal issues they raise, whilw proposing solutions in this regard. El ordenamiento penal español protege la inviolabilidad del domicilio frente a su ocupación ilegítima, tipificando diversas conductas y sancionando penalmente aquellas que, desde una perspectiva político-criminal, revisten mayor gravedad. No obstante, en la práctica, el titular legítimo del inmueble puede verse privado de su derecho de uso y disfrute sin una respuesta inmediata por parte de las autoridades, lo que en ocasiones le lleva a recurrir a vías de hecho que pueden constituir a su vez, ilícitos penales, como coacciones, realización arbitraria del propio derecho, usurpación o allanamiento de morada. El presente artículo analiza estos tipos penales y las principales controversias que generan, proponiendo soluciones al respecto. [ABSTRACT FROM AUTHOR]
