CIVIL LIABILITY OF COMPANIES PROVIDING PERSONAL DATA IN JORDANIAN LEGISLATION.

ناولت الدراسة الأحكام القانونية الناظمة للشركات المزودة للبيانات الشخصية في إطار التشريع الأردني بهدف حل إشكالية الدراسة المتمحورة في البحث بطبيعة المسؤولية المدنية للشركات المزودة للبيانات الشخصية في التشريع الأردني، وذلك بالاعتماد على المنهج التحليلي. وقد خلصت الدراسة إلى مجموعة من النتائج أهمها إنَّ المشرع الأردني لم يشر إلى الطبيعة القانونية للمسؤولية المدنية للشركات المزودة للبيانات، على الرغم من أنه كان يتوجب عليه من باب أولى تفصيلها تفصيلاً دقيقًا في قانون حماية البيانات الشخصية. وعليه، أوصت الدراسة بأن يتولى المش رع الأردني صياغة إطار قانوني متكامل ين ظم أحكام الشركات المزودة للبيانات الشخصية دقيق وشامل، بما يس هل على الباحثين في الفقه والقضاء فهم هذه الطبيعة القانونية، ويوفر عليهم الجهد والوقت في تفسير النصوص المتفرقة أو غير الواضحة. The study examined the legal provisions governing companies providing personal data in Jordanian legislation with the aim of solving the study's issue centered on researching the nature of civil liability of companies providing personal data in Jordanian legislation, by relying on the analytical approach. The study concluded that the Jordanian legislator did not refer to the legal nature of the civil liability of data providers, although it should have been detailed in the Personal Data Protection Law. Accordingly, the study recommended that the Jordanian legislature should formulate an integrated legal framework that regulates the provisions of companies providing personal data accurately and comprehensively, making it easier for researchers in jurisprudence and the judiciary to understand this legal nature and saving them time and effort in interpreting sporadic or unclear texts.
