Civil Liability for Damages Arising from the Use of Cosmetics.

لقد اتجهت أغلب دول العالم نحو تطوير القوانين الخاصة لحماية المستهلك مما قد يصيبه من أضرار نتيجة استخدام مستحضرات التجميل وذلك نظرا لافتقاده الخبرة الفنية والقانونية التي تمكنه من حسن الاختيار وذلك بسبب استخدام سبل الغش التجاري وتعددها واستخدام * وسائل التكنولوجيا الحديثة في فن الخداع والتعليب والتغليف المستحضرات التجميل ونتيجة الخطورة الضرر الناشئ عن استخدام تلك المستحضرات وما يتعلق بها من محاذير جمة ترتبط بسلامة الصحة ووجود الكثير من البحوث التي تحذر من علاقة بعض المركبات بالإصابة ببعض أنواع من الأمراض كالسرطان فقد قننت أغلب الدول المسئولية المدنية عن مستحضرات التجميل ومن أبرزها العراق وذلك وفقا لقانون الصحة العامة العراقي رقم ۸۹ لسنة ۱۹۸۱م، وعليه هدفت تلك الدراسة إلى إبراز المسئولية المدنية عن الأضرار الناشئة عن استخدام مستحضرات التجميل بالمقارنة بين النظام القانوني في دولة العراق وغيره من الأنظمة المقارنة كالنظام السعودي والفرنسي. وتختلف الأحكام القانونية المتعلقة بالمسؤولية الناشئة عن أضرار مستحضرات التجميل من بلد لآخر، ولكن في المجمل تتضمن هذه الأحكام تنظيماً دقيقاً للمنتجات التجميلية وإجراءات رقابية لمراقبة جودتها وسلامتها بالإضافة إلى تحديد العقوبات القانونية لمن يخالف هذه الأحكام. وقد يكون هناك قصور في القانون العراقي فيما يخص المسؤولية الناشئة عن أضرار مستحضرات التجميل، وذلك يعتمد على قوة وفعالية تلك القوانين في التطبيق العملي [ABSTRACT FROM AUTHOR]

Most of the countries of the world have tended towards developing special laws to protect the consumer from the damages that may befall him as a result of the use of cosmetics, due to the lack of technical and legal expertise that enables him to make a good choice, due to the use of commercial fraud and its multiplicity, and the use of modern technology in the art of deception, packaging and packaging of cosmetics, and as a result Due to the seriousness of the harm resulting from the use of these cosmetics and the many related precautions related to health safety and the existence of a lot of research that warns of the relationship of some compounds with infection with some types of diseases such as cancer, most countries have legalized civil liability for cosmetics, most notably Iraq, in accordance with the Iraqi Public Health Law No. 89 of 1981 AD, and accordingly this study aimed to highlight the civil liability for damages arising from the use of cosmetics in comparison between the legal system in the State of Iraq and other comparative systems such as the Saudi and French systems.
