- Abstract:
This non-regulatory guidance discusses provisions that govern within-district allocations under Title I, Part A (Title I) of the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the Every Student Succeeds Act (ESSA), and accompanying regulations in 34 C.F.R. §§ 200.64, 200.77, and 200.78. It first addresses required and authorized reservations of Title I funds by a local educational agency (LEA) and then outlines how an LEA, with the Title I funds that remain after the reservations, identifies eligible Title I school attendance areas and allocates Title I funds to public schools. The U.S. Department of Education is issuing this guidance to provide LEAs with information to assist them in meeting their obligations under the ESEA and implementing regulations. Other than statutory and regulatory requirements included in the document, the contents of this guidance do not have the force and effect of law and are not meant to bind the public in any way. This document is intended only to provide clarity to the public regarding existing requirements under the law or agency policies.
