THE LEGAL NATURE OF THE PROCEDURAL LEGAL BUSINESS

O atual Código de Processo Civil, buscando a efetividade e celeridade da tutela jurisdicional, trouxe diversas inovações no sistema processual brasileiro, dentre elas a possibilidade de as partes realizarem negócios jurídicos que estipulem mudanças no procedimento. Com isso, ampliou-se significativamente a participação da vontade das partes durante o procedimento judicial, reforçando o sistema cooperativo intencionado pelo legislador. Para adequada compreensão do negócio jurídico processual, objeto de estudo do presente trabalho, mostra-se relevante o exame de sua natureza jurídica, de forma a fixar conceitos indispensáveis para se exprimir a essência do instituto jurídico em questão. Trata-se do objetivo deste artigo. A pesquisa realizada se refere a um estudo descritivo de caráter dogmático-jurídico, por meio da análise da legislação correlata e da revisão bibliográfica de juristas que exploram com profundidade a temática da negociação processual. Através dela constatou-se tratar-se o negócio jurídico processual de fato jurídico voluntário cujo suporte fático proporciona ao sujeito processual a faculdade de modificar o procedimento judicial e regular determinadas situações jurídicas.
The current Code of Civil Procedure, seeking the effectiveness and speed of judicial protection, brought several innovations to the Brazilian procedural system, including the possibility for the procedural parties to conduct legal business that stipulate changes in the procedure. This significantly increased the action of the parties’ will during court proceedings, reinforcing the cooperative system intended by the legislator. For a proper comprehension of the procedural business, object of study of this paper, it is relevant the inspection of its legal nature, in order to settle essential concepts to state the essence of this legal institute. This is the purpose of this paper. The research carried out is a descriptive study with dogmatic-juridical character, through the analysis of the related legislation and the bibliographic review of jurists who deeply explore the subject of procedural negotiation. Through it, it was found that the procedural legal business is a voluntary legal fact whose factual support provides the procedural subject with the ability to modify the judicial procedure and regulate certain legal situations.
