AUTONOMÍA DE LA VOLUNTAD Y CONTRATOS DE ARRENDAMIENTO DE BIENES INMUEBLES DE CORTA DURACIÓN EN EL RÉGIMEN COMUNITARIO DE COMPETENCIA JUDICIAL INTERNACIONAL

En este artículo se analiza la posibilidad de actuación de la autonomía de la voluntad respecto de la regla de competencia judicial internacional regulada en el art. 22.1 b) del Reglamento 44/2001 relativa a los contratos de arrendamiento de bienes inmuebles de corta duración. Este precepto posee una singularidad que no se encuentra en el resto de foros exclusivos, puesto que en él se establece la concurrencia de dos tribunales que pueden conocer en exclusiva. La acción de la autonomía de la voluntad podría deshacer esa concurrencia y actuar como una cláusula de clarificación de la competencia judicial internacional. ; In this article it is analyzed the possibility of performance of the agreement on jurisdiction respect of the rule of international jurisdiction regulated in the art. 22.1 b) of the Council Regulation 44/2001 regarding to the contracts which have astheir object tenancies of immovable property concluded for temporary private use for a maximum period of six consecutive months. This rule has a singularity that it is not possible to find in the rest of exclusive forums, provided that in it is established the concurrence of two courts that can know in exclusive jurisdiction. The action of the agreement on jurisdiction might undo this concurrence and act as a clause of clarification of the international jurisdiction.
