Hizmet Tespiti Davalarında İş Sözleşmesi ile Adi Ortaklık Sözleşmesinin Tespitine İlişkin Ölçütler ; Criteria for Determination of the Partnership Agreement with the Employment Agreement in Action for Fixing of Period of Service

Hizmet tespiti davalarında, taraflar arasındaki hukuki ilişkinin ihtilaflı olması durumunda hukuki ilişkinin hangi sözleşmeden kaynaklandığının tespiti gerekir. Bu bağlamda adi ortaklık sözleşmesi, taraflar arasındaki hukuki ilişkinin ortaklık sözleşmesine değil, iş sözleşmesine dayandığının iddia edilmesi halinde hizmet tespiti davalarına konu olabilecektir. Bu noktada taraflar arasındaki hukuki ilişkinin niteliği ve bu niteliğin tespit edilebilmesi için dikkate alınabilecek ölçütler önemlidir. Çalışmamızda aradaki hukuki ilişkinin tespiti, adi ortaklık sözleşmesinin tanımı ve unsurları ile iş sözleşmesi ve unsurları karşılaştırma yapılmak suretiyle açıklanacaktır. Bu doğrultuda ilk olarak genel anlamda ortakların ve işçilerin sigortalılık statüsüne değinilecek, hizmet tespit davası hakkında genel açıklamalarda bulunulacak, akabinde ise aradaki hukuki ilişkinin tespitine ilişkin faydalanılabilecek ölçütlerden bahsedilip, konuya ilişkin yargı kararlarına yer verilecektir. ; Action for fixing of period of service, if the legal relationship between the parties is in dispute, it is necessary to determine which contract the legal relationship originates from.
