A IDENTIFICAÇÃO CRIMINAL POR MEIO DO PERFIL GENÉTICO

This article will analyze the constitutionality of the compulsory analysis of DNA testing, divided into three topics, it will deal with the conflict of fundamental rights to intimacy and privacy and, on the other hand, the right to public security, physical and moral integrity in the context of suspects if undergo compulsory DNA testing. For that, it will be used descriptive-explanatory research of the documental-bibliographic type, with deductive bias, using the weighting technique of Robert Alexy. We seek to discuss possibilities of limitations for the right to privacy. First, it will address human dignity, analyzing whether it is an absolute or relative principle. Subsequently, it will analyze the compulsory DNA examination, where Brazilian legislation and jurisprudence does not provide for this procedure. Finally, he will talk about the right to public security. We conclude that it will be possible to have compulsory DNA extraction in suspects of violent crimes in criminal prosecution, provided that there is specific legislation. Keywords: Human dignity, Compulsory DNA examination, Public Security. ; O presente artigo analisará a constitucionalidade da análise compulsória do exame de DNA, dividido em três tópicos tratará sobre o conflito dos direitos fundamentais à intimidade e à privacidade e por outro lado o direito à segurança pública, à integridade física e moral no contexto de suspeitos se submeterem ao exame de DNA compulsório. Para tanto, utilizar-se-á pesquisa descritivo-explicativa do tipo documental-bibliográfica, com viés dedutivo, com a utilização da técnica de ponderação de Robert Alexy. Buscamos discutir possibilidades de limitações para o Direito à intimidade. Primeiramente abordará a dignidade humana, analisando se é um princípio absoluto ou relativo. Posteriormente fará uma análise sobre o exame de DNA compulsório, onde legislação e jurisprudência brasileira não prevê este procedimento. Por fim, falará sobre o direito a segurança pública.
