      In the contemporary landscape of connected vehicles, where automobiles offer a plethora of digital services, a pivotal question emerges: Should vehicle manufacturers be classified as telecommunications companies under European law? This article examines the reasons why such a categorization is unwarranted. By analyzing the legal definition of electronic communications service providers, the scope of machine-to-machine (M2M) connectivity services, the ancillary nature of telecommunications services provided by vehicle manufacturers, and the potential regulatory implications, this study provides a comprehensive assessment supported by current legislation, resolutions from relevant telecommunications agencies, and the contractual relationships between vehicle manufacturers, telecommunications companies, and end customers. ; En la era de los vehículos conectados, donde los automóviles ofrecen servicios digitales avanzados, surge una pregunta crucial: ¿deberían los fabricantes de vehículos ser considerados empresas de telecomunicaciones? Este artículo explora por qué, bajo el derecho europeo, los fabricantes de vehículos no deben ser clasificados como tales. Analizamos las definición legal de proveedores de servicios electrónicos de comunicaciones, el alcance de los servicios de conectividad máquina a máquina (M2M), la naturaleza accesoria de los servicios de telecomunicaciones proporcionado por los fabricantes de vehículos y las implicaciones regulatorias, todo ello, apoyándonos en la legislación vigente, la resolución de ciertas agencias de telecomunicaciones y la relación contractual entre los fabricantes de vehículos con las empresas de telecomunicaciones y el cliente final.
