      Brak se kao institucija pojavio tisućama godina unazad i opstao do danas. Učinci koje brak ima dijele se na osobnopravne učinke i imovinskopravne učinke. Zbog imovinskopravnih učinaka koje brak ima, poželjno je urediti imovinskopravne odnose sklapanjem bračnog ugovora. Time se odvaja vlastita imovina od zajedničke imovine koja se ubraja u bračnu stečevinu. Bračnim ugovorom uređeni imovinskopravni odnosi olakšavaju postupak podjele imovine nakon rastave te se na taj način može izbjeći sudsko odlučivanje o podjeli imovine. Kada dođe do razvoda braka i na sudu je da podjeli imovinu jer supružnici nisu sklopili bračni ugovor, sud treba obratiti pažnju da odlučuje ne samo u interesu supružnika nego i trećih osoba. To se posebno odnosi na djecu kao treće osobe i njihovu dobrobit. Kako bi se razvod učinio što manje stresnim za sve uključene preporučljivo je dakle poduzeti dva koraka: urediti imovinskopravne odnose sklapanjem bračnog ugovora i sporazumno se razvesti. ; Marriage as an institution emerged thousands of years ago and has endured to this day. The effects of marriage are divided into personal and property- related effects. Due to the property related effects of marriage, it is advisable to regulate property relations by concluding a prenuptial agreement. This separates personal property from joint property which is considered marital property. Property relations regulated by a prenuptial agreement facilitate the division of property after divorce, and can thus help avoid court intervention in property division. When a divorce occurs and the court is responsible for dividing property because the spouses did not conclude a prenuptial agreement, the court must consider not only the interests of the spouses but also those of third parties. This especially applies to children as third parties and their well-being.
