State Regulation on the Duty to Preserve Buildings ; La regulación estatal del deber de conservación de inmuebles

The paper analyses the current legal regime regarding the duty to preserve the buildingsforeseen in the State planning regulations. Three types of preservation are defined and theirregimes and limits are analyzed, with special attention to the regime applicable to listed buildings.In order to properly understand the duty of preservation, it is essential to understand the socialfunction that defines the content of the property right and substantiate the owner’s legal duty topreserve the buildings and the obligation to face the financial burdens that may arise from this duty. ; Se analiza el régimen jurídico actual del deber de conservación de inmueblesprevisto en la normativa urbanística estatal. Se definen tres tipos de deberes deconservación y se estudia su régimen y límites, con especial atención al régimen delos edificios protegidos. Resulta clave para entender en sus justos términos el deberde conservación partir de la función social que delimita el contenido del derecho depropiedad y que justifica que los propietarios tengan el deber legal de conservar susinmuebles y afrontar las cargas económicas que se deriven de este deber.
