Conditions and Problems of Shari’ah Supervision in Islamic Bank of Thailand ; สภาพและปัญหาการกำกับดูแลชะรีอะฮ์ของธนาคารอิสลามแห่งประเทศไทย

This study aimed to find out conditions and problems of Shari’ah Supervision of Islamic Bank of Thailand. The qualitative study employed was the document research and the in-depth interviews, the samples were the three key informants selected by purposive sampling, and Islamic jurisprudence description, the interpretation and the inductive conclusions were used as the data analysis methods. The study found that the Shari’ah Supervision of Islamic Bank of Thailand was there are also operational components that need to be developed and improved to comply with the international Shari’ah Supervision standards to be more effective. It was found five major problems as follows: 1) policy and legislation framework problems, 2) tax and fees load problems, 3) working standard problems, 4)lack of the Shariah expert problems, 5)lack of the support from the government problems., the Thai government and all relevant agencies have to support and promote the Shari’ah supervision advance the working standards, revise the legislation that hinders operations, and establish all supportive factors to strengthen the supervision of the Shari’ah of Islamic bank of Thailand to promote Islamic Bank of Thailand to be recognized by others. ; บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาสภาพและปัญหาการกำกับดูแลชะรีอะฮ์ของธนาคารอิสลามแห่งประเทศไทย เป็นการศึกษาเชิงคุณภาพที่เก็บรวบรวมข้อมูลจากการศึกษาเอกสารและการสัมภาษณ์เชิงลึกกลุ่มผู้ให้ข้อมูลสำคัญจำนวน 3 ท่าน ซึ่งได้มาโดยวิธีการเลือกแบบเจาะจง ส่วนการวิเคราะห์ข้อมูลผู้วิจัยใช้วิธีการวิเคราะห์ทางกฎหมายอิสลาม เชิงพรรณนา ตีความ และสร้างข้อสรุปแบบอุปนัย ผลการศึกษา พบว่า สภาพการดำเนินงานด้านการกำกับดูแลชะรีอะฮ์ของธนาคารอิสลามแห่งประเทศไทยในภาพรวมยังมีองค์ประกอบบางด้านที่จะต้องได้รับการพัฒนาและปรับปรุงแก้ไขให้สอดคล้องกับมาตรฐานการดำเนินงานด้านการกำกับดูแลชะรีอะฮ์สากลมากขึ้น ได้แก่ 1) ปัญหาด้านหลักนโยบายและกฎหมาย 2) ปัญหาด้านภาระภาษีและค่าธรรมเนียม 3) ปัญหาด้านมาตรฐานการปฏิบัติงาน 4) ปัญหาด้านขาดบุคลากรผู้เชี่ยวชาญ และ 5) ปัญหาด้านขาดการส่งเสริมจากภาครัฐ นอกจากนี้ ...
