The information rights and powers of consultation of workers’ representatives may in practice converge with the business power of qualifying business secrets. In this sense, the new regulation presents an evident relationship between the power to determine business secrets and business obligations to inform workers’ representatives in labor matters. In the same way, the possible concurrence of the business secret with the duty of secrecy of the representatives of the workers is raised. The legal protection of business secrets would not affect the autonomy of workers’ representatives and the constant information relationship. This new regulation would not restrict collective information rights to workers’ representatives, which are essential in our democratic model of labor relations. coexist with the figure of professional secrecy of workers’ representatives.       La Ley 1/2019, de 20 de febrero, delimita una noción de secreto empresarial que en determinadas situaciones puede concurrir con la figura del deber de sigilo profesional de los representantes de los trabajadores. Los derechos de información y las facultades de consulta de los representantes de los trabajadores pueden en la práctica confluir con el poder empresarial de calificar secretos empresariales. En este sentido, la nueva regulación presenta una relación evidente entre la facultad de determinar secretos empresariales y las obligaciones empresariales de información a los representantes de los trabajadores en materias de contenido laboral. Asimismo, se plantea la posible concurrencia del secreto empresarial con la noción de deber de sigilo de los representantes de los rabajadores. La protección legal de los secretos empresariales no afectaría a la autonomía de los representantes de los trabajadores y a la consiguiente relación de información constante. Esta nueva regulación no restringiría los derechos colectivos de información a los representantes de los trabajadores, que son esenciales en nuestro modelo democrático de relaciones laborales.
