      U radu se razmatraju pravila Općeg građanskog zakonika o zakonskom nasljeđivanju bračnih drugova, kao i odgovarajuća pravila bračnog prava, posebno pravila kojima su uređeni imovinski odnosi u braku. Dopunu normativne analize predstavljaju rješenja iz ostavinskih spisa kotarskih sudova Zagreba, Samobora i Velike Gorice sačuvana u Državnom arhivu u Zagrebu te objavljena sudska praksa. Pritom je autoričina namjera bila utvrditi kako je tekla primjena pravila zakonskog nasljeđivanja bračnih drugova, kakve su se nejasnoće pritom javljale i jesu li bila opravdana osporavanja tih pravila na hrvatsko-slavonskom pravnom području.
      According to General Civil Code the fact of marital relationship was not equalized with the fact of kinship, so the surviving spouse was accepted as the inheritor, however there were additional specificities regarding his/her legal hereditary position.Thus the hereditary position of the spouse was dependent on a widely defined circle of the testator's relatives as potential legal inheritors, regulating property relations between married couples and subsequently regulating the private legal position of the wife. In view of the fact that the spouse competed for the inheritance with all the testator's relatives, the form and scope of his/her right to the inheritance, i.e. the fructus right or the right of ownership actually depended on which of the relatives put in an application together with the spouse for inheritance. It could happen, therefore, that although the spouses had been working and creating property for years the surviving spouse had far less right to the inheritance than the testator's descendents, especially the testator's distant relatives. The system of separate goods applied to the property relations of the married couple and, unless otherwise agreed, each spouse was the owner of the property he/she brought into the marriage and had no right to the property that the other spouse had acquired during the marriage. However, for property acquired during the marriage, when there were doubts as to whom it belonged, it was considered that it derived from the husband. Considering such regulation of property relations in marriage and the number of limitations which wives encountered while acquiring property, the wife, as the surviving spouse, was often deprived of her inheritance rights and acquired only fructus rights, and possibly an ownership right to a small part of the bequest.       Nach dem Allgemeinen Bürgerlichen Gesetzbuch war die Tatsache der ehelichen Verbindung der Tatsache der Verwandtschaft nicht völlig gleichgestellt, weshalb der überlebende Ehegatte als Erbe zwar akzeptiert, seine erbrechtliche Position jedoch mit einigen Besonderheiten ausgestattet war. So war der Erbanspruch des Ehegatten durch einen weit gefassten Kreis von Verwandten des Erblassers als potenziellen gesetzlichen Erben, durch die Güterstandsregelung zwischen den Ehegatten sowie durch die daraus folgende privatrechtliche Stellung der Frau bedingt. Da der Ehegatte im Erbfall mit allen Vewandten des Erblassers konkurrierte, hingen Form und Umfang seines Erbanspruchs, d.h. Nießbrauchsrecht oder Eigentumsrecht, davon ab, mit welchem dieser Verwandten er seinen Erbanspruch geltend macht. Daher konnte es vorkommen, dass der überlebende Ehegatte, obwohl die Ehegatten Jahre lang ein Vermögen erarbeitet hatten, einen erheblich geringeren Erbanspruch hatte als die Nachkommen des Erblassers und insbesondere als entfernte Verwandte des Erblassers. Im Güterstand zwischen den Ehegatten galt das System der Gütertrennung, sodass jeder Ehegatte, falls nichts anders vereinbart war, Eigentümer des von ihm in die Ehe eingebrachten Vermögens war und keinen Anspruch auf den vom anderen Ehegatten während der Ehe erworbenen Zugewinn hatte. Das während der Ehe erworbene Vermögen aber, dessen Zugehörigkeit zweifelhaft war, galt als vom Ehegatten erworben. In Folge einer solchen ehelichen Güterstandsregelung sowie zahlreicher Einschränkungen beim Gütererwerb für die Ehegattinnen waren sie als überlebende Ehegatten in ihrem Erbrecht oft benachteiligt und erhielten nur das Nießbrauchsrecht oder gegebenenfalls das Eigentumsrecht an einem geringeren Teil des Nachlasses. Diesen Sachverhalt bestätigen die Nachlassakten von drei Bezirksgerichten, aus denen hervorgeht, dass der überlebende Ehegatte in der Regel die Ehegattin war, die den Nachlass gemeinsam mit den Nachkommen des Erblassers antrat und
