The study analyzed the relationship between the regulatory framework of property rights and the registration system for property transfers in Lima in 2022. It concluded that a robust regulatory framework, adapted to social and economic realities, is crucial for defining and protecting property rights, promoting responsible and beneficial use for society. Coordination between the institutions responsible for property regularization and registration is essential to reduce informality and legal conflicts, providing stability to the real estate market. The research, of a basic type and descriptive-correlational design, found a medium positive correlation (r = 0.639) between the registration system and property rights. It recommends implementing actions to improve the efficiency and security of real estate transactions in Lima. This includes strengthening the legal and institutional framework, improving cadastral records, and facilitating transparent and efficient property transfer and management.It is essential that the regulatory framework integrates principles of property rights theories, balancing individual and social interests. Addressing informality in property rights is a priority, requiring measures to reduce disorganization and improve records and the legal framework. In summary, an integrated approach is needed to ensure greater legal security in real estate transactions, promoting a more stable and reliable market.
El estudio analizó la relación entre el marco regulatorio del derecho de propiedad y el sistema registral de transferencia de predios en Lima en 2022. Concluyó que un marco regulatorio sólido y adaptado a las realidades sociales y económicas es crucial para definir y proteger los derechos de propiedad, promoviendo un uso responsable y beneficioso para la sociedad. La coordinación entre las instituciones responsables de la regularización y el registro de la propiedad es fundamental para reducir la informalidad y los conflictos legales, proporcionando estabilidad al mercado inmobiliario. La investigación, de tipo básico y diseño descriptivo correlacional, encontró una correlación positiva media (r = 0.639) entre el sistema registral y el derecho de propiedad. Se recomienda implementar acciones para mejorar la eficiencia y seguridad en las transacciones de bienes inmuebles en Lima. Esto incluye fortalecer el marco legal e institucional, mejorar los registros catastrales y facilitar la transferencia y gestión de la propiedad de manera transparente y eficiente. Es esencial que el marco regulatorio integre principios de las teorías del derecho de propiedad, equilibrando intereses individuales y sociales. Abordar la informalidad en el derecho de propiedad es prioritario, requiriendo medidas para reducir la desorganización y mejorar los registros y el marco legal. En resumen, se necesita un enfoque integral para garantizar mayor seguridad jurídica en las transacciones inmobiliarias, promoviendo un mercado más estable y confiable.
