The principle of the rule of law requires the existence of a specific and expected legal system, and that every individual is treated by decision-makers in a manner that preserves his rights and freedom. Their behavior and defines all types of prohibited acts for them, and this in turn requires the presence of a legal state that bases its work on a legal structure and respects human rights. أن مبدأ سيادة القانون يتطلب وجود نظام قانوني محدد ومتوقع، وأن يعامل كل فرد من جانب صناع الق ا رر بطريقة تحفظ حقوقه وحريته ، ولعل مبدأ الشرعية الجنائية هو السياج الذي يصون الحريات والحقوق الفردية، وحرية الأف ا رد وحقوقهم تبقى مهددة إذا لم يكن هناك قانون جنائي يرسم لهم حدود تصرفاتهم ويحدد لهم كل أنواع الأفعال الممنوع إتيانها،وهذا الأمر يتطلب بدوره وجود دولة قانونية تستند في عملها على بنيان قانوني وتحترم حقوق الإنسان .
