    • Abstract:
      The 'argumentative requirements' established to assess the admissibility of constitutional complaints ended up eliminating the public and informal nature of the public action of unconstitutionality. This article provides empirical evidence of how the development of the Constitutional Court's case-law has encouraged its 'privatization'. We refer to two simultaneous phenomena: the generalized restriction to exercise the citizen's right to participate in the control of political power through this figure; and the concentration of its use and enjoyment in an elite: lawyers. Our models suggest a strengthening of unjustifiable inequalities in the exercise and enjoyment of the rights incorporated in this action. These inequalities are present between lawyers and non-lawyers and between men and women. Finally, we point out how its effects should be considered when reviewing the action's scope and content.       Las 'cargas argumentativas' exigidas en las demandas de inconstitucionalidad terminaron de eliminar la naturaleza pública e informal de la acción de inconstitucionalidad. El presente artículo evidencia empíricamente cómo el desarrollo jurisprudencial de la Corte Constitucional ha incentivado su 'privatización'. Nos referimos a dos fenómenos simultáneos: la restricción generalizada para ejercer el derecho ciudadano de participar en el control del poder político a través de esa figura, y la concentración de su uso y goce en una élite: los abogados. Nuestros modelos probabilísticos advierten el robustecimiento de desigualdades injustificables en el ejercicio y goce de los derechos incorporados en esta acción, tanto entre abogados y no-abogados como entre hombres y mujeres. Señalamos que los efectos de la operación de esta acción deben ser tenidos en cuenta al momento de revisar sus alcances y contenido y sugerimos algunas medidas para su futuro desarrollo.
