Background and Impacts to the Right of Strike as a Consequence of Colombia’s Entry into the Organization for Economic Co-operation and Development (OECD). (English)

This article endeavours to analyse the main issues identified by the OECD within Colombian legislation and practices on the right to strike (as a key tool for the effective defence of constitutional rights of association, negotiation, and freedom of unions). Thus, it will identify the effects, mid and long terms adjustments and projections Colombia has committed to along with expectations and best practices to be potentially implemented by the government and legislative authorities. Este artículo representa un esfuerzo para el análisis de las principales problemáticas identificadas por la OCDE, en la legislación y las prácticas colombianas actuales, respecto al ejercicio del derecho a la huelga en Colombia (elemento necesario para garantizar la efectiva defensa de los derechos constitucionales a la asociación, la negociación y la libertad sindical). Así, se identificarán los efectos en el mediano y largo plazo, junto con los ajustes y proyecciones a los que Colombia se ha comprometido, así como las expectativas y mejores prácticas que potencialmente podrán ser implementadas por el gobierno y el legislador.
