PROVISION 12/2020 OF CGJ / SP AS AN INSTRUMENT FOR CONCRETEING CITIZENSHIP DURING PANDEMIC COVID 19 ; PROVIMENTO 12/2020 DA CGJ/SP COMO INSTRUMENTO DE CONCREÇÃO DA CIDADANIA DURANTE A PANDEMIA COVID 19

The purpose of this article is to demonstrate that the Provision 12/2020 issued by “Corregedoria Geral de Justiça” from São Paulo state’s has become an effective means of concretizing citizenship by enabling the practice of notarial acts electronically during the pandemic generated by Covid 19. Therefore, through the analysis of the essentiality of the notary function for the realization of various legal business and considering that social distance is necessary at this moment to prevent the spread of the disease, it is evident that the Provision allowed the economy not to was stagnant and that through it the civil element of the concept of citizenship envisaged by Marshal was not violated, allowing the right to property and to make contracts not to be interrupted during the crisis. ; O presente artigo tem como finalidade demonstrar que o Provimento 12/2020 expedido pela Corregedoria Geral de Justiça do estado de São Paulo tornou-se um meio efetivo de concreção da cidadania ao possibilitar a prática de atos notariais eletronicamente durante a pandemia gerada pelo Covid 19. Sendo assim, por meio da análise da essencialidade da função notarial para concreção de diversos negócios jurídicos e considerando que o distanciamento social faz-se necessário neste momento para evitar a propagação da doença, evidencia-se que o provimento permitiu que a economia não fosse estagnada, e que por meio dele, o elemento civil do conceito de cidadania previsto por Marshal não foi violado, permitindo-se que o direito à propriedade e de efetuar contratos válidos não sejam interrompidos durante a crise.
